This agreement is made and executed by and between the "RENTER" and "MARIA JONWIL CAR RENTAL".
MARIA JONWIL CAR RENTAL hereby leases to the RENTER of the vehicle described on the front page thereof, subject to all terms and condition contained herein and consideration thereof, the RENTER agrees.
A. To used the leased unit in good condition and legal purposes and intentions only. All unconsumed rental will not be refunded.
B. The RENTER shall not directly or indirectly Sub-lease or transfer the rental of the said vehicle to a Third Party without the consent of MARIA JONWIL CAR RENTAL, and any such agreement made violation of this clause shall be null and void.
C. A days rental is equivalent to 24 hrs, excess hour will be charged at P200.00 per hour. If rental covers Five (5) hours the daily rate shall be applied.
D. Gasoline, Parking Fees and Penalties are for RENTER’S Account.
E. RENTER should pay the carwash fee of P200.00 for hatchbacks/sedan and P250.00 for SUV & Pick Up car types.
F. SMOKING, DRINKING OR BRINGING FOUL ODOURS FOOD ( DURIAN OR MARANG ) inside the car is prohibited, hence there will be an additional charge for sanitising or detailing of the car.
G. Car accessories such as stereo, speaker, seat cover, tires and etc. are not covered by the insurance. Loss of such items shall be liability of the RENTER.
H. To be liable for all the cost of repairs, retouch or restoration of the unit from the damages acquired by the RENTER during the duration and to be liable for the daily rental of the foregoing motor vehicle during the time of repair until the day the same vehicle is fully restored and repaired to the original conditions:
I. It is the RENTER’S responsibility for all the Lost Car Keys and or Lock out situations.
J. To pay all the fees and charges in accordance with the stipulations and computations of the agreement.
K. Failure to pay the rental agreed date, MARIA JONWIL CAR RENTAL shall have the right to pull out the. Leased vehicle any time and place thereof without any prior notice to the RENTER.
L. RENTER shall be liable pay at the rate if Seven percent (7%) per month in case of delay in payment of rental fee within the period provided. Immediately upon the return of the vehicle . Should the matter be referred to a lawyer, it is agreed that the RENTER shall pay Attorney’s fees at the rate of twenty five percent (25%) of the amount due but in case shall it be less that P8,000.00, in addition to the cost of the unit. RENTER hereby consents that in case of suit arising out of or in connection with the agreement, the venue is agreed to be at Cagayan de Oro City.
